A loved one is sent to a detox to get their life back on track, and due to the detox facility's negligence, the loved one passes away. This is Rehab Center Malpractice. Sometimes their medication is mismanaged, their withdrawal symptoms are not properly addressed, a fellow patient brings drugs into the detox - unfortunately these are the realities of how we lose loved ones at this vulnerable level of care. This should never happen, and it is our goal to fight for justice for the families, parents, and children who are left behind. As your rehab negligence lawyer, we are experts in Treatment Center Malpractice Law.
A parent sends their child to the care of a rehab facility - many times the rehab is hundreds of miles away in another state. The parent trusts this facility to protect and care for their child in a time of crisis. Through no fault of the parents, their child does not come home. This is an unfortunate reality.
This is rehab center malpractice, and you should consider hiring a treatment center malpractice law expert. We fight for the rights of parents who lose their child at the hands of a rehab facility on a daily basis. Our mission is simple - make sure that this type of thing never happens to another parent.
A person checks into a rehab facility or a detox in West Palm Beach, Port St. Lucie, Tampa, or another city in Florida. The medical team evaluates this person and creates a medical and clinical plan, prescribes medications, and creates a treatment objective.
There is a misdiagnoses in the treatment plan, the wrong medication is prescribed, an allergy is not addressed properly and this person is injured. This is an unfortunate common occurrence and we are here to help. As lawyers with deep experience in Treatment Center Malpractice law, we are the rehab negligence lawyers for you or your loved ones.
A person in a recovery residence fails a drug test or gets in a dispute with their program operators. The rehab or house managers decide to kick this person out. The patient is told to pack his belongings and leave the facility - given no plan for transitioning out. The person with substance use problems is left stranded at a bus stop, grocery store, or worse, simply told to leave into the night.
For an addict, this is high risk and should never happen. A qualified drug and alcohol rehabilitation facility, detox, or sober living house should never kick someone out into the night without offering a plan. Many times the addict who has been negligently discharged buys drugs and experiences overdose. This happens far too often, and our team is equipped to help you or a loved one if they have experienced this.
A person enters rehab or detox to address their substance use disorder. The person trusts the facility to provide healing and support. The person finds themselves subjected to unwanted, inappropriate, or unethical advances by staff. The patient is captive to the treatment facility, and has difficulty rejecting the advances. The patient experiences an unwanted touching or a sexual assault at the hands of the employee of the treatment center. This should never happen.
If you, your loved one, or a friend has suffered this harm please reach out. Attorneys Susan Ramsey and Ryan Ingraham have experience helping people through sexual trauma, and fighting for patient's rights.
A client goes into a treatment facility in hopes of finding a solution to their drug and alcohol problem. A therapist, behavioral health technician (BHT), or other rehab employee pursue a relationship with the patient.
This is not normal, and should never occur in this setting. If you or somebody you know has gone through a similar experience, we are here to help.
Sometimes, due to to the negligence of the facility, drugs make their way into the drug and alcohol rehab facility. Today, there is no telling what is in street drugs, and more times than not these street drugs are laced with Fentanyl.
Drug and alcohol rehab facilities should be safe places for addicts and alcoholics. There are instances where these facilities cease to be safe places for ourselves, families, and loved ones and become havens for drug use and other illicit activities. Unfortunately, patients fall victim to their substance use disorder, use drugs, and overdose.
If this has happened to you, a friend, or a loved one, please feel free to reach out so that our team can hold the drug and alcohol rehab facility accountable.
Drug addiction does not discriminate. People from all walks of life suffer from Substance Use Disorder.
An unfortunate reality of this drug rehab industry is people are harmed by the negligence of drug rehab facilities. Sometimes, persons with Substance Use Disorder pass away while still patients of these facilities. They leave behind children and families.
These are the cases that we handle. Our goal is to ensure this stops happening for good, and no child is left parent-less due to the actions or inactions of drug and alcohol rehabilitation facilities.
Unfortunately many patients in drug rehab facilities or detoxes are experiencing the traumas of having lived an addicted life. There are a mix of very vulnerable patients and patients who are predatory. Facilities must have safeguards in place to protect these vulnerable patients from the harms of others.
Sometimes, these drug rehabs and detoxes fail to protect their patients. It is not uncommon for patients to experience sexual battery, unwanted advances, or even sexual assaults at the hands of other patients. A majority of these events go unreported. This is something the drug rehab has an obligation to prevent for the safety of its patients. If you or somebody you know has suffered this type of harm, we are here to help.
Some patients are on medically assisted treatment (MAT) for many years and have had a slip back to hard drugs. Some patients are prescribed medications such as Buprenorphine (Subutex) or Suboxone to assist in their treatment plan.
We have seen many instances where a patient of a facility is immediately taken off this medication in the interest of "abstinence" and the patient suffers side effects. One of the clear and unquestionable side effects of immediately ceasing MAT is relapse on a drug of choice. Sometimes this is done by the facility improperly, and the results can be deadly.
If you have experienced this situation, we are here to help.
There are drug and alcohol rehabilitation facilities that market themselves as safe spaces for hopeful recovering addicts to heal. When the addict arrives he realizes he is housed in an unsafe location - drug dealers next door, many overdoses in the residence, active drug activities taking place inside the residence at the purported treatment center.
This is not an uncommon occurrence, and if you are injured as a result of unsafe housing of a drug rehab or sober residence, please feel free to give us a call.
A person enters a drug and alcohol treatment center or detox with the expectation that their staff is properly trained and understands the addict or alcoholic. Sometimes, this is not the case. There is abusive staff, untrained persons working, or worst of all active addicts and alcoholics working at these rehabs.
If you are injured as a result of the negligent hiring, untrained or unsafe staff at a detox or rehab, please feel free to contact us for a case evaluation.
